Volusia County Prevails in Court Against Belvedere Terminals Over Proposed Fuel Site-Denies Motion To Disqualify GrayRobinson
Circuit Judge Dennis Craig recently ruled against Belvedere Terminals in their legal battle with Volusia County, denying their request for a court order to process a site plan for a fuel facility near Ormond Beach. The ruling followed a lawsuit filed by Belvedere Terminals, represented by GrayRobinson, challenging the county's delay in processing their application. The company also sought a temporary injunction, which was denied.
County Attorney Michael Dyer expressed that the ruling supported the county's position. GrayRobinson accused the county of violating Belvedere Terminals' rights by not following its own rules. The hearing drew considerable public interest, with arrangements made for virtual viewing, though some attendees reported difficulties in hearing the proceedings.
The proposed fuel terminal has raised public concerns about safety, traffic, and environmental risks. Despite these concerns, Belvedere Terminals asserts the project's safety. The County Council is considering a nine-month moratorium on heavy industrial zoning, affecting the proposed site, with a final vote scheduled for February 6. Belvedere Terminals argues that the moratorium is invalid due to lack of public notice and accuses the county of bad faith.
Judge Craig also rejected a motion by Volusia County to disqualify GrayRobinson as the company's legal representation, citing a potential conflict of interest. The judge's decision to deny the temporary injunction was based on the lack of demonstrated likelihood of success for Belvedere Terminals' site plan, the potential harm from the moratorium, and the absence of adequate legal remedies.
Pedestrian Accident Claims Life of 71-Year-Old Woman on A1A in Ormond Beach
A 71-year-old woman was fatally injured after being hit by an SUV while crossing State Road A1A in Ormond Beach. The accident occurred on Monday at around 6:42 p.m. near the intersection with Bosarvey Drive. According to sources, the woman was crossing to her family's condo but was not in a crosswalk at the time. She paused at the median due to traffic and then proceeded to cross the northbound lanes of A1A, where she was struck by the vehicle.
The woman was taken to the hospital, where she later died from her injuries. The accident resulted in the closure of A1A in both directions for about three hours as police conducted their investigation. The driver of the SUV involved in the incident stayed at the scene and cooperated with the authorities.
The Ormond Beach Police Department is actively investigating the crash and has requested anyone with information to contact them. Following the accident, the police department has emphasized the importance of pedestrian safety, advising the public to use crosswalks, stay visible, obey traffic signals, and be cautious in high-traffic areas.
Record Rolex Crowds at Daytona Speedway Fuel Local Hospitality Surge
The 62nd Rolex 24 at Daytona brought not only a thrilling race but also significant economic benefits to Ormond Beach and surrounding areas. Local businesses, particularly hotels and restaurants, saw a surge in customers and revenue. The race, which witnessed Felipe Nasr's victory, attracted a record crowd, partly due to the perfect weather and the presence of Brad Pitt, who was filming a movie in the area.
Hotels like The Shores Resort & Spa reported full occupancy and higher average daily rates, a trend consistent across the region. The last-minute demand for rooms contributed to these increased rates. The Starlite Diner and other local eateries also experienced a boost in business, with race crowds adding to their regular customer base.
Premier Resorts & Management, with several properties in the area, achieved full occupancy and higher rates. The positive impact of the race extended to their DeLand property as well. Looking ahead, these businesses anticipate similar success during the upcoming Daytona 500, with many already reporting strong bookings.
Overall, the Rolex 24 at Daytona significantly benefited the local economy, with businesses across various sectors enjoying the influx of race fans and the heightened excitement brought by the event.
CDC Issues Nationwide Alert for Measles Following Multiple Outbreaks
The CDC has issued a nationwide alert to healthcare providers to be vigilant for measles cases following multiple outbreaks and a potential mass exposure at two Washington-area airports by an international traveler. Between December 1, 2023, and January 23, 2024, the CDC reported 23 confirmed measles cases, including seven linked to international travel.
Healthcare professionals are advised to look out for symptoms like febrile rash, cough, or conjunctivitis, particularly in patients who have recently traveled abroad. The CDC emphasizes rapid isolation of suspected measles cases in healthcare settings and adherence to standard and airborne precautions.
The CDC also reiterated the importance of measles vaccination, noting that most cases involve unvaccinated young children. Recent research supports the beneficial effect of administering the measles vaccine following the DTP or DTAP vaccine.
Notices have been issued in the District of Columbia and Virginia about a measles case involving a traveler who passed through Dulles International Airport and Ronald Reagan Washington National Airport. Authorities are working to identify and contact potentially exposed individuals.
The alert follows an increase in measles cases across the U.S., with confirmed cases in Missouri, Georgia, New Jersey, and Pennsylvania. Over 1,200 cases have been reported since 2019. The CDC's warning highlights the contagious nature of measles, which spreads through the air and manifests in two stages, beginning with symptoms like fever and runny nose, followed by a distinctive rash.
