Flagler County Eyes Harsher Laws Against Dune Trespass Amid Erosion Crisis

In an urgent response to the ongoing coastal erosion, Flagler County, Florida, is poised to escalate legal penalties for unauthorized access to beach dunes. The County Commission is set to vote on Monday on an emergency order that would classify walking on the dunes as a second-degree misdemeanor, subject to up to 60 days in jail and a $500 fine. This measure, described by Flagler County Attorney Al Hadeed during a recent public address, underscores the critical need to protect these vulnerable natural barriers, which suffer from frequent damage due to hurricanes, Nor’easters, and other tidal events.

The proposed crackdown comes as part of a broader effort by local authorities to preserve the county's shorelines, which have been battered by a series of intense weather events in recent years. At a luncheon hosted by the Flagler Tiger Bay Club, Hadeed highlighted the ecological importance of the dunes and the lengthy six-month recovery period required for dune vegetation to strengthen after being disturbed.

Further emphasizing the severity of the situation, Hadeed recounted the county's struggles with significant beach erosion, notably following Hurricane Matthew in 2016 and Tropical Storm Nicole in 2022, which led to substantial damage to infrastructure including the collapse of parts of Highway A1A.

Local officials, including Hadeed, have praised efforts by the Army Corps of Engineers to renourish the beaches and have committed to a long-term plan to manage and restore the coastline with limited resources but abundant determination. Hadeed’s speech articulated a community-driven resolve, stating that despite financial constraints, "grit and determination" have been central to the county's strategy to combat beach erosion.

As the County Commission convenes to deliberate on the emergency order, the stakes are high for Flagler County's beaches, which are crucial not only for environmental sustainability but also for the community's safety and economic well-being.
