5 New Florida Laws In Effect As Of January 1, 2024

- House Bill 01627: Bail and Pretrial Release Revisions

  • Amends Florida law to ensure only judges have the authority to set, lower, or change bail for defendants.

- House Bill 7061: Child Protective Investigations

  • Passed unanimously in the Florida Legislature.

  • Transfers responsibility for child protective investigations from seven sheriff’s offices to the Department of Children and Families (DCF).

  • DCF to handle child protective investigations statewide post-enactment.

- House Bill 1275: "Protect Our Loved Ones" Act

  • Authorizes local law enforcement to establish a "Persons with Disabilities Registry.

  • The registry is for individuals with conditions such as autism, Alzheimer’s, Down syndrome, etc., to aid police interactions.

- House Bill 012077: Privacy for Persons with Disabilities Registry

  • Companion bill to the "Protect Our Loved Ones" Act.

  • Ensures information in the Persons with Disabilities Registry and similar local registries is exempt from public records.

- House Bill 00109: State Park Reservations

  • Allows Florida residents to reserve state park cabins and campsites, including various types, 11 months in advance.

  • Non-residents can book up to 10 months ahead.

  • Florida residents booking over 10 months in advance must provide a Florida driver's license or ID card number for verification.

New Smyrna Beach to Implement Strict Measures for Unpaid Parking Tickets in 2024

In New Smyrna Beach, a new enforcement approach to unpaid parking citations is set to begin in January 2024. According to City Ordinance 78-50, any vehicle with three or more unpaid parking tickets found on public roads or properties will be subject to booting. The vehicle's registered owner will then have a 24-hour window to clear the outstanding citations. Failure to do so will result in the vehicle being towed and impounded. The release of the vehicle will only be granted once all fines, including the boot removal fee and towing expenses, are paid in full.

Volusia County Mobilizes Shelters Amidst Chilly Forecast

In response to the forecasted cold snap, Volusia County is taking proactive steps to ensure the well-being of its residents by opening cold weather shelters on Friday and Saturday. In our area, The Neighborhood Center's The Bridge will welcome residents seeking refuge from the chilly temperatures between 6 p.m. and 8 p.m. Additionally, Halifax Urban Ministries is collaborating with local churches to extend their shelter services. Residents in need of these facilities or looking to make arrangements can reach out to Halifax Urban Ministries at 386-317-5886 for assistance and further information.

Holiday Schedule Changes for Garbage and Recycling Pickups

Residents of the city and unincorporated Volusia County should note changes in garbage and recycling collection schedules due to the upcoming holiday season. On New Year's Day, Monday, January 1, there will be no garbage or recycling services.

In the city, the adjusted schedule will see Monday's collections shifted to and January 2. Similarly, Tuesday collections will occur on Wednesday, January 3. Collections usually scheduled for Wednesday will take place on Saturday, January 6.

For those residing in unincorporated Volusia County, the holiday schedule adjustment will follow a sequential shift. Collections for Monday will be moved to Tuesday, and this pattern will continue through the week, with Friday's collections occurring on Saturday.

Ormond Beach Police Department

  • John R. Schulz, 54, of Ormond Beach, was arrested Dec. 15 and charged with possession of paraphernalia and controlled substance without a prescription. Bail was set at $5,500

  • Bennett M. Greenberg, 72, of Ormond Beach, was arrested Dec. 17 and charged with burglary of an unoccupied dwelling, grand theft and possession of a controlled substance without prescription. Bail was set at $17,500.

Holly Hill Police Department

  • Treondis Lavale Shurn, 21, of Holly Hill, was arrested Dec. 15 and charged with aggravated battery on a pregnant person and obstruct officer without violence. Bail was not set.

Volusia County Sheriff’s Office

  • Kimberly Ann Hawthorne, 35, of Ormond Beach, was arrested Dec. 15 and charged with possession of amphetamine and resisting an officer without violence. Bail was not set.

  • Dario M. Roland, 49, of Ormond Beach, was arrested Dec. 16 and charged with battery. Bail was set at $10,000.

  • Adam James Hughes, 36, of Ormond Beach, was arrested Dec. 16 and charged with possession of controlled substance without a prescription, cannabis and paraphernalia, and trespassing. Bail was set at $5,000.

  • Holly Anne Drake Kolath, 43, of Ormond Beach, was arrested Dec. 16 and charged with possession of paraphernalia, cannabis and a controlled substance without a prescription and trespassing. Bail was set at $5,000.
