Volusia County's Decision on Industrial Zoning Moratorium Pushed to February

The Volusia County Council has postponed its vote on a moratorium for developments in heavy industrial zones until February 6th. This decision follows a request from an attorney representing Belvedere Terminals for a quasi-judicial review, as the moratorium would primarily affect a property intended for a fuel terminal by Belvedere Terminals. The moratorium concerns five properties near Ormond's city limits, owned by various entities including Florida East Coast Railway and Waste Management Inc. of FL.

Initially proposed in late November 2023, the moratorium aims to give county staff time to review and amend the list of permitted uses in heavy industrial zones. The potential nine-month moratorium, which could be terminated earlier by the council, is a response to the current broad scope of permitted uses in these zones. The council's actions indicate a move towards more specific and possibly tighter development regulations in heavy industrial areas.

Customers May Be Owed Money in Verizon's $100 Million Lawsuit Settlement

Verizon has agreed to a $100 million settlement in a class-action lawsuit alleging that the company charged undisclosed administration fees in a deceptive manner. This settlement affects charges made to customers from January 1, 2016, to November 8, 2023, with a claim submission deadline set for early spring 2024. The lawsuit, filed in New Jersey, has not seen a court decision on the validity of the claims or defenses.

The settlement does not constitute an admission of liability or wrongdoing by Verizon. The company continues to deny any improper conduct and asserts the lawsuit is without merit. Verizon also plans to keep charging the administrative fee and may adjust it in the future. As part of the settlement, Verizon will revise its Customer Agreement to include clearer disclosures about the Administrative Charge.

Florida Senator Proposes Bill for Stronger Police Protections Following Officer Jason Raynor’s Death

Following the sentencing of Othal Wallace for the death of Officer Jason Raynor, a Florida senator has proposed Senate Bill 1092, the “Officer Jason Raynor Act”, to enhance legal protections for police officers. This bill is a response to the 2021 incident where Officer Raynor was fatally shot by Othal Wallace during an investigation. Volusia County Sheriff Mike Chitwood supports the bill, advocating for respect towards the legal system and condemning violence against officers.

The bill aims to make it illegal to use or threaten force in resisting arrest or detention and in resisting an officer's lawful duties. The legislation is influenced by the Raynor-Wallace case, where Wallace claimed self-defense but was convicted of manslaughter and sentenced to 30 years. The new bill proposes life imprisonment without parole for those convicted of manslaughter in the death of an officer, marking a significant change in the legal repercussions for such crimes.
